A proposed development of new homes at North Elmham which has already been delayed for two years because of difficulties over legalities was yesterday given a reprieve.
Breckland planners agreed that applicant Land and New Homes can have a further nine months to sort out the problems surrounding the scheme to develop land adjacent to Station Road at North Elmham.
The application for the site was originally submitted to Breckland planners in October 2007.
As part of the planning process, a Section 106 Agreement was drafted to secure education and library contributions .
The application was formally considered by development control board members on March 17, 2008 who agreed to defer the application subject to completion of the Section 106 Agreement.
Yesterday members were told in a report that despite the best efforts of various parties, including solicitors and Norfolk county council the Agreement still has to be completed so the scheme has been delayed.

But although officers recommended that planning consent should be refused because of failure to complete the Agreement, members decided that the applicants should be given a further nine months in which to complete the Agreement.
The proposed site is a large parcel of vacant land. It is accessed via Station Road which runs parallel to the site's southern boundary. To the east and south of the site are existing residential properties and to the west are commercial pre4mises , disused station building, platform and track.
